1. WHAT IS MOON PAPER TOYS CLUB?

1.1. SERVICES. The CLUB is an online store, selling printable paper toys and activities Kits to be printed and assembled by the customer. The CLUB also offers informative and didactic content about creative play on our blog and newsletter.

1.2. SUSPENSION. We reserve the right to suspend or cancel, at any time, your access to the application in case of suspected fraud, obtaining an illicit benefit or advantage, or for not complying with any conditions set out in these Terms of Use, Privacy Policy, Cookie Policy, Sales Policy and Exchange and Return Policy.

In such cases, no indemnity will be owed to you, and the CLUB will be able to take competent action, if necessary, as well as take any other necessary measures to pursue and safeguard your interests.

2. HOW DO I ACCESS MOON PAPER TOYS CLUB?

2.1. NAVIGATION. Browsing the website can be done freely, without making any prior registration, and will allow viewing of all products and content posted on our blog.

2.2. ACCESS. The purchase is conditional on filling out a registration form. To register, you will provide us with personal data, as described in our Privacy and Data Protection Policy (access and learn more here).

2.3. AGE OF USE. To make purchases and interact on/with the platform, you must be at least 18 (eighteen) years old. 2.4. OWNERSHIP. From the registration, you will be the holder of an account that can only be accessed by you. If the CLUB detects an account made from false information, by users who, for example, do not have the minimum age allowed, that account will be automatically deleted.

2.5. UPDATE OF INFORMATION. From now on, you are committed to keeping your personal information up to date, especially your e-mail address. You also agree that you will keep your login and password safe and out of the reach of third parties and will not allow your CLUB account to be used by others. In this way, you, the user, are responsible for all actions performed on your account.

3. RIGHTS OF THE MOON PAPER TOYS CLUB

3.1. OUR RIGHTS. All rights related to the CLUB and its functionalities are the exclusive property of MOON PAPER TOYS CLUB, including its texts, images, layouts, software, codes, databases, graphics, articles, photographs and other content produced directly or indirectly by us (“CLUB CONTENT”).

CLUB Content is protected by copyright and intellectual property law. It is expressly forbidden to use, copy, reproduce, modify, translate, publish, transmit, distribute, execute, upload, display, license, sell or explore and reverse engineer the “CONTENT OF MOON PAPER TOYS CLUB”, for any purpose, without the CLUB's prior and express consent.

Any unauthorized use of the CLUB Content will be considered a violation of copyright and intellectual property.

3.2. INTELLECTUAL PROPERTY. For us at the CLUB, the quality of the materials made available to the user is of extreme importance. 3.4. DOWNLOAD CONTENT. It is prohibited for the user to download our content in order to store it in a database to offer to third parties other than the user. It is also forbidden that the content made available by us is used to create a database or a service that can compete in any way with the MOON PAPER TOYS CLUB business.

4. RESPONSIBILITIES OF THE USER AND THE MOON PAPER TOYS CLUB

4.2. RESPONSIBILITY FOR ANY DAMAGES. The CLUB, its affiliates, partners or employees will not, under any circumstances, be held responsible for direct or indirect damages resulting from, or related to, accessing or using or inability to access or use the CLUB.

4.3. LOSSES. When there is no legal requirement, the CLUB and the suppliers or distributors will not be responsible for loss of profits, loss of revenue, loss of data, financial losses or for indirect, special, consequential, exemplary or punitive damages to users.

4.4. MAINTENANCE. It is your entire responsibility to keep your device's environment (cell phone, computer, tablet, among others) safe, with the use of available tools, such as antivirus, firewall, among others, in order to contribute to the prevention of electronic risks.

4.5. EXTERNAL LINKS. It is possible that in the CLUB’s website may contain links to third party websites and applications, as well as having integrated technologies. This does not in any way imply that the CLUB endorses, verifies, guarantees or has any connection with the owners of these sites or applications, and is not responsible for their content, accuracy, policies, practices or opinions. The CLUB recommends that you read the Terms of Use and Policies for each third-party website or service that the user comes to visit or use.

4.6. EXCLUSION OF LIABILITY. When the CLUB facilitates your interaction with independent third party providers, this does not mean that the CLUB endorses, verifies, guarantees, recommends or owns any connection with those third parties. IN THESE SITUATIONS, THE CLUB ACTS AS A MERE FACILITATOR IN THE TRANSACTION BETWEEN YOU AND THESE THIRD PARTIES, SO THE CLUB IS NOT A PROVIDER OF GOODS OR SERVICES, WHICH ARE PROVIDED DIRECTLY BY INDEPENDENT THIRD PARTY PROVIDERS.

5. HOW DOES THE CLUB DEAL WITH THE CONTENT YOU AND OTHER USERS PRODUCE?

5.1. CONTENT CREATION. The CLUB may, at its discretion, allow you or any other user to display, upload, publish or make available, in the application, text, image, audio or video content or information ("User Content").

5.2. PROHIBITED CONTENT. Any defamatory, injurious, violent, pornographic, obscene, offensive or unlawful User Content is prohibited, as determined by the CLUB at its sole discretion, including information of EXCLUSIVE PROPERTY BELONGING TO OTHER PEOPLE OR COMPANIES (e.g. copyright, marks), WITHOUT THE EXPRESS AUTHORIZATION OF THE HOLDER OF THESE RIGHTS, SUCH VIOLATION WILL NOT BE LIABLE FOR THE MOON PAPER TOYS CLUB.

5.3. CONTENT OWNERSHIP. Any User Content provided by you remains your property. However, by providing it to the CLUB, you grant us a worldwide license, for an indefinite period of time, free of charge and transferable, and with the right to sublicense, use, copy, modify, create derivative works, distribute, publish, display this User Content in all possible formats and distribution channels, without the need for further notice to you, and without the need for any payment, provided that this is related to the functioning of the platform or the services and products offered by the CLUB (Example: Supply of texts, drawings, materials, activities etc.; Comments and publications on our platform).

5.4. EXCLUSION OF THE CONTENT. The CLUB may, but does not undertake to analyze, monitor and remove User Content, at the CLUBE's sole discretion, at any time and for any reason, without any notice to you.

6. WHAT ELSE DO I NEED TO KNOW ABOUT THESE TERMS OF USE?

6.1. CHANGES. To improve your experience, the CLUB is always being updated. For this reason, these Terms of Use can be changed, at any time and for any reason, to reflect the adjustments made.

However, whenever any modification occurs, the information will be highlighted with the date of the update on the website.

If you do not agree with the new Terms of Use, you can reject them, but unfortunately, this means that you will no longer be able to access and make use of the features that depend on CLUB REGISTRATION.

If you use our application anyway after the application of changes to these Terms of Use, it means that you agree to all changes.

6.2. CONFLICT BETWEEN PROVISIONS. In the event of a conflict between these terms and the later updated terms, the modifying terms will prevail with respect to that conflict.

6.3. LAW AND JURISDICTION. These Terms of Use are governed by Brazilian law. Any doubts and situations not provided for in these Terms of Use will be FIRST resolved by MOON PAPER TOYS CLUB and, if they persist, may be resolved by the forum of Brasília / DF, excluding any other, however privileged it may be.
